Kroger agreed to a $17 million fund over claims it reported inflated usual and customary prescription prices by ignoring its Savings Club prices, which caused some insured customers to overpay. If you used insurance to pay any part of a prescription at a Kroger pharmacy between December 9, 2018 and August 23, 2026, you can file for a share sized by what you spent.

The claim deadline is December 21, 2026. Records are required only if you claim $8,000 or more, or if Kroger's data does not identify you. The case is 2:21-cv-00022 in the Southern District of Ohio, and Kroger denies wrongdoing.

Filing is free on the official site. Payout is a discovery app, not a law firm, and cannot promise a figure.

How the payout amount is decided

After approved costs come out of $17 million, the administrator divides the rest among valid claims in proportion to each person's eligible prescription spending. You enter or estimate what you paid Kroger for insured prescriptions during the class period. Larger totals get larger shares. The per-person figure is unknown until claims close in December.

Who qualifies

  • You are an individual in the U.S. or a U.S. territory.
  • You paid all or part of at least one prescription at a Kroger pharmacy using insurance.
  • The purchase fell between December 9, 2018 and August 23, 2026.
  • You are not in an excluded group listed in the official notice.

When money arrives

The facts available do not list a final approval date. Payment follows court approval and any appeals after December 21, 2026, and the proportional math means nothing goes out until every claim is tallied.

How to file

Open the form at the Kroger Savings Club Settlement site, enter your contact details and any claim ID you received, enter or estimate your insured prescription spending, attach records only if you claim $8,000 or more or the administrator asks, sign, and submit by December 21, 2026. Or let Payout file it for you, free.
